Removal Notice from Bailiffs


Bailiffs are officials appointed by the court and given permits to work for the government organizations such as courts that have given fines for misdemeanours committed or traffic authorities. Bailiffs are different from debt collectors, debt collector’s work for banks or other institutions that you owe money and have failed to pay back. Debt collectors have little powers compared to bailiffs. Bailiffs can come to your home and take your properties instead of money to cater for the unpaid debt that you owe the government department concerned. In this case, if you refuse to co-operate, they can ask the police to come in and maintain order while they take the assets.
Allowing bailiff entry in your home
When accepted in the house, bailiffs will demand the payment of the amount owed, but in most cases, we fail to have paid depts. Due to financial constraints, in this case, if you cannot afford to pay the whole amount, bailiffs can make a controlled goods agreement with you. A managed goods agreement is an agreement showing a repayment method you will use to pay for the debt, but this is usually made with some bailiff fees.
What if you do not allow bailiffs in your house?
If you do not allow bailiffs into your premises, they got various choices to make according to the type of debt you owe. Bailiffs, in this case, can force entry and pick your assets, or can live then later send you a notice, of which if you don’t abide by it they will come and take your assets. It is very unlikely, though for them to force entry because there are opportunities for you to pay without force. In the following kind of debts, they have chances of using force though:
Council tax
Catalogue or credit card debts
Parking tickets owed
Energy or phone companies arrears.
You also have the rights to stop bailiffs, in the first instance, you should not allow them in the house, You can keep them outside and talk through the window or closed door, as them for the full information on the debt they have come to collect, you can ask them to provide you all the legal documents under the door or below the locked door. Ensure the documents are in date, your name and correct addresses. If any of this is wrong, you can ask the bailiffs to leave you will contact their offices and explain. Make sure you have all the proof it is not your debt, or it’s not a debt at all.
If you know the debt and accept to owe the named liability, don’t worry! You can ask the bailiffs to live you will make plans with the head office on how to pay the loan. If the bailiffs insist you should let them in or you must pay the debt at the doorstep, be brave and do not let them intimidate you. Bailiffs are not allowed to force themselves in, in their first visit.
